This book examines the roles of regional community courts in economic integration, focusing on the EACJ and CJEU as institutions addressing socio-economic and political challenges to integration. It highlights the difficulties faced by regional economic blocs in Africa, particularly within the East African Community, that impede effective trade liberalization. The thesis posits that regional community courts are crucial in overcoming these challenges and fostering integration. A comparative analysis is conducted between the EACJ and CJEU, with the latter serving as a model for effectively interpreting Community Treaties to mitigate economic and political barriers in the EU. The study questions the adequacy of the EACJ’s legal and institutional framework in promoting integration and assesses its active role in tackling challenges to regional economic integration. This evaluation involves examining various indicators related to the Court's structure, processes, and decision-making procedures. The study concludes with recommendations for the EACJ and stakeholders to enhance the Court’s capacity for fostering economic integration. It also draws practical lessons from the EU/CJEU to improve the EAC's dispute settlement system and the EACJ's functionality in promoting integration.
