This book is open access under a CC BY 4.0 license and explores the unique aspects of the current presidential election system that have not been addressed in other works. It contends that any new rules for electing a President must ensure equal representation of states as members of the Union and reflect the will of the nation as a whole. The analysis includes the National Popular Vote plan, which may infringe upon Supreme Court rulings regarding the equality of votes in statewide elections for electors, potentially violating the Equal Protection Clause of the Fourteenth Amendment. The book proposes a new election system where the President and Vice President are elected through direct popular elections across all 50 states and D.C. This system aims to ensure that the elected President is the choice of both the nation and the states as equal members of the Union. It suggests that the current system should only elect a President if there is no consensus among the nation and the states. Additionally, it encourages nationwide campaigning by candidates. The updated second edition includes a proposal to facilitate the participation of established non-major party and independent candidates in national televised presidential debates alongside major-party candidates.
