For citizens seeking political activity, membership of a political party is one of the most effective form of participation in political will-formation. Conversely, political parties rely in a number of ways on their members, who are their most important resource and essential for the existence and functioning of the party. Out of this complex relationship there arise many issues that must be legally clarified relating for instance to the potentialities and modalities of membership participation in political parties, and especially the right to participation in will-formation within a party as well as the right of a party to levy subscriptions and to discipline recalcitrant members. This volume endeavours to draw up the legal relationship between parties and members from the basic principles under constitutional law and, working from here, to examine it from its initial formation to termination.
