      Qualitativ empirische Einblicke am Beispiel des § 54a KWG

      Die Arbeit beschäftigt sich mit der Schnittstelle zwischen Straf- und Aufsichtsrecht. Am Beispiel des § 54a KWG wird empirisch untersucht, wie sich das Strafrecht in Bereiche der prinzipienorientierten (Finanz-)Aufsicht einfügt. Um am kognitiven Potential der Institute zu partizipieren, normiert der Gesetzgeber mit § 25c Abs. 4a KWG prozedurale Anforderungen an das Risikomanagement und überlässt die konkrete Art der Umsetzung dieser Vorgaben den Instituten. Zugleich hat der Gesetzgeber mit § 54a KWG einen Verstoß gegen diese Risikomanagementvorgaben strafbewehrt. Dies führt zwangsläufig zu Spannungsverhältnissen – insbesondere mit den Zielen des Aufsichtsrechts und der vom Gesetzgeber normierten institutsinternen Wissensgenerierung.
