Im Dezember 2002 hat der Europäische Rat eine neue Verordnung zu den Durchführungsvorschriften der Art. 81, 82 EG erlassen, die das bisherige System tiefgreifend reformiert. Die Arbeit setzt sich mit dieser Reform auseinander und geht im zentralen Teil der Frage nach, ob der Anwendungsbereich der Art. 81 und 82 EG aus rechtsdogmatischen und aus rechtspolitischen Gründen durch eine Neuausrichtung der Zwischenstaatlichkeitsklausel einzuschränken sei, wobei auf den Integrationsstand der Gemeinschaft, das Subsidiaritätsprinzip und das Prinzip des Ordnungswettbewerbs eingegangen wird. Die Unterschiede werden schließlich durch einen summarischen Vergleich des Vorschlags des Verfassers mit den Entscheidungen von EG-Kommission und EuGH zum Bankensektor besprochen.
