Die Untersuchung beleuchtet die aktuellen Einschränkungen des Beweisantragsrechts zur Bekämpfung von Missbrauch und stellt zentrale Fragen zur Definition und Abgrenzung von Missbrauch. Anhand einer Analyse des Ziels des Beweisantragsrechts werden verschiedene Fallgruppen des Rechtsmissbrauchs entwickelt.
